Palestine Mandate Legally Triumphs Over Discredited PLO Charter…writes David Singer

The 1922 League of Nations Mandate for Palestine – and international law – have finally emerged as triumphant victors over the 1964 PLO Charter following the collapse of 50 years of failed attempts by the PLO to arbitrarily void the vote of the 51 members of the League of Nations unanimously endorsing the legal right of the Jewish people to reconstitute the Jewish National Home in 23% of former Palestine.

This significant PLO defeat and loss of face follows the ignominious end – on 29 April 2014 – of the nine months negotiating deadline period imposed on Israel and the PLO by US Secretary of State – John Kerry – designed to achieve the “two- state solution” – the creation of a second Jew-free Arab State – in addition to Jordan – in former Palestine for the first time ever in recorded history.

The American and PLO failure to achieve the “two-state solution” after 20 years of fruitless negotiations represents a lost opportunity not likely to return for a long time – leaving the political prestige influence and credibility of those much vaunted negotiators in total disarray in the rapidly growing silent and abandoned diplomatic graveyard.

The PLO – since its formation in 1964 – had arrogantly strode the world stage claiming Palestine as the sole property of the Arab nation whilst simultaneously denying the Jewish people any right to live in their 3000 years-old Jewish ancient, legally sanctioned and biblical homeland.

Article 18 of the 1964 PLO Charter had brazenly declared:

” The Balfour Declaration, the Palestine Mandate System, and all that has been based on them are considered null and void. The claims of historic and spiritual ties between Jews and Palestine are not in agreement with the facts of history or with the true basis of sound statehood. Judaism, because it is a divine religion, is not a nationality with independent existence. Furthermore, the Jews are not one people with an independent personality because they are citizens to their states.”

Four years later article 18 had been replaced with a more strident, equally dismissive article 20:

“The Balfour Declaration, the Mandate for Palestine, and everything that has been based upon them, are deemed null and void. Claims of historical or religious ties of Jews with Palestine are incompatible with the facts of history and the true conception of what constitutes statehood. Judaism, being a religion, is not an independent nationality. Nor do Jews constitute a single nation with an identity of its own; they are citizens of the states to which they belong.”

This outright rejection of international law by the PLO has never been questioned by the League of Nations compliant successor – the United Nations – which – acting in clear breach of Article 80 of the UN Charter knowingly collaborated to prolong the Arab-Jewish conflict in violation of international law when welcoming the PLO purveyor of Jew-hatred -Yasser Arafat – into its midst with adulation and enthusiastic applause on 13 November 1974.

The acceptance of this terrorist organisation into the realm of civilised political discourse by the United Nations whilst the PLO simultaneously continued to assert that the League of Nations had no power to make any legally binding decisions – must surely rank among the most shameful episodes and low points in United Nations history.

Lecturing to Israel on international law whilst allowing the PLO to reject international law was breathtaking hypocrisy on the United Nations part.

The principle of respect for the law was cast aside by United Nations members as they trashed the original and noble principles enunciated in the Mandate on the altar of expediency and national self- interest

Adopting countless condemnatory General Assembly resolutions of non – binding validity those spineless members lined up with the automatic majority represented by Arab Islamic and third world member States to sell out their souls to appease an organisation of terrorists, law-deniers and Jew-haters.

Former UN Secretaries General stood by in silence as anti-Israel resolutions denigrating and delegitimising Israel were ramped up with ever increasing hatred.

The legal commitments enshrined in the Mandate had previously stood resolutely firm against this Arab assault on the Jewish National Home since 1922 – as partition proposals by the Peel Commission in 1937 and a newly created United Nations in 1947 were contemptuously shredded into the garbage bin of history by an Arab leadership that would not brook any compromise or reconciliation with the Jewish people.

The advent of major wars including the 1948 War of Independence, the 1967 Six Day War and the 1973 Yom Kippur War brought staggering losses and suffering for both Arabs and Jews as the Arab League armies still vainly attempted to eliminate the Jewish State and the consequences of the Mandate.

Whilst the PLO fails to recognise Israel as the Jewish State – no peace between Jews and Arabs is realistically likely to occur.

The Arab League and Kerry have the power to create a breakthrough – pressuring Jordan and Israel to redraw the internationally recognised boundary between their respective countries as successor States to the Mandate for Palestine

In view of their loss of political clout do these neutered politicians and the United Nations really possess the diplomatic ability to make peace finally happen?

Using the wisdom and political sagacity of their League of Nations ancestors – the miracle created by the Mandate for Palestine 92 years ago is hopefully set to resurface.as attempts to rescue the peace process are started once again,

    Gil,

    I am not crazy about legalistic jargon either, I have me own, but, sorry mate, David is incredibly right on a number of fronts:
    Front #1. Current realities confirm in a spectacular manner that the “legalistic” provisions were tenable, achieved and here to stay, i.e. we DO have in OUR Israel a Jewish home AS stipulated by those “legalistic” docs.
    Front#2. By incidence of non-legalistic nature ( let’s call it Providential ) the ENTIRE Arab anti-Israel/Zionist concoction is all but gone MILITARILY. If in ’67 and ’73 those bastards could muster armies and dare attack our land, they are all but finished today. With the exception of Iran, there is NO other State in the world that is calling today for war against Israel, let alone form any kind of formal alliance. The only residues are Hezbollah and the tin soldiers about Gaza. What this means is precisely what David Singer and all those dedicated Zionists ( including YOU ) are left to do. That is put to rest all these visceral antisemitic initiatives whether at local palestinian level or much larger in the idiotic world of palestinian fellow-travelers and all degrees of supporters.
    The “war” we are fighting is on the barricades of cogent arguments and here David Singer is doing the work of a top soldier and we should all march with him ( I’d be happy to be just a corporal….).
    This IDF auxiliary of dedicated Zionists has heaps to do, if we consider alone the scurge of the BDS.
    Otherwise, balfour, San Remo, Sevres or not, Israel is in the best ever strategic and security position.
    The political onslaught devised by the PA has as its aims the recognition of an entity which does NOT meet the most basic criteria for a respectable political entity, let alone the modicum of a proper STATE. While the two state solution seems irreversible, the basic preconditions of a civilised structure, content-ethics by the possible future palestinian state entity need to be met without any promiscuous allowances, any concessions, be it educational, ideological etc.
    Israel is, once again, now in the driver’s seat and abandoning the recent “peace negotiations” was only an organic, inevitable, necessary gestures.
    Kerry, Ashton and whoever are but transitory figures, shortly they shall be gone and forgotten, except for those who need to hark on the irrelevant.

    So, David, is corporal ok with you !!?? By the way, I prefer my uniform pale khaki, waist size 48, beret extra large to fit the proportions of my head !!!!

      You deserve to be awarded the rank of Field Marshal with baton and all ceremonial regalia.All those “experts”who openly supported the the PLO calling for Israel’s return to the 1949 armistice lines to create a third Arab state in addition to Jordan for the first time in recorded history should hang their heads in shame and should be placed under your charge to get rid of the trash and garbage spouted by the PLO for the last 50 years.
      At least you were not fleeced by the propagandists and their blatant lies.

    Don’t you get tired of your relentless legalistic mantra?
    The 1922 mandate did not triumph over anything.
    Kerry, Obama and Abbas simply could not get what they wanted, that is for Israel to commit suicide.

      50 years has seen the PLO achieve nothing but fairy floss and bubbles leaving Oslo, the Bush Roadmap and the world’s most powerful politicians who professed supreme optimism in the “two- state solution “with nothing but dented reputations and egg on their collective faces.

      The legalistic mantra set out so explicitly and clearly in the Mandate for Palestine recognising the legal right of the Jewish people to reconstitute the Jewish National Home in Palestine has repelled all PLO attempts to declare the Mandate null and void since 1964

      Pity you cannot see the wood for the trees. Neither could these ignoramuses Hopefullythey will start looking for other solutions to end the 92 years old conflict rather than trying to prolong it.

        One thing though David.
        In 50 years the PLO has indeed had one major victory.
        They have, in the eyes of many, been able to turn history on its head in their pursuit of the fictitious “Palestinian” narrative.
        It is a great pity there were not articulate and clear thinking speakers within Israel with the depth of your historical knowledge to have gotten up and spoken in the media and at international forums.
        Thanks to this silence from within Israel, many now believe the “Palestinian” narrative is the truth. The Jewish nation is sorely in need of strong leadership. It is my opinion that the likes of Shimon Peres, Tzipi Livni & Co. should be under house arrest for opening the door to the current mayhem in Israel today.

          The PLO campaign has been exposed as a gigantic hoax of massively fictitious proportions

          Those people who swallowed the PLO propaganda bait hook line and sinker such as Peres,Livni ,Obama and Kerry – not to mention the Quartet – are all indeed looking decidedly stupid today.

          They have had their authority and credit irreparably damaged and become the laughing stock of the world’ s diplomatic community.

          Listening to anything they say from now on should be promptly consigned to the garbage bin.
          Who could trust their opinion or rely on anything they say?
          The PLO had one victory – it made complete fools of those gullible opinion makers – including the media and our Famous ex Foreign Minister who would have been prepared to buy the Sydney Harbour bridge if either Abbas, Arafat or Erekat had offered to sell it to them.

          The Palestinian “narrative ” is not the truth but a lot of lies floating on quicksand which hopefully will soon sink out of sight. Maybe those who were taken in will be a lot more critical in the future

          The truth will always win out – and thankfully -after 92 years – it has

            The way Israel is going on, it appears that the entire leadership from the Government, Judiciary to the Military have been indoctrinated in a left wing appeasement agenda that bodes ill for the safety and security of the entire nation. Livni is still in place, Shimon Peres is still the President and Netanyahu is still carrying on as if the so called “peace talks” are still in progress. How is it that he doesn’t rule out the release of the 3rd batch of murderers and has frozen building application permits for Judea and Samaria? Only an insane country hell bent on suicide demotes a combat veteran for defending himself. Israel is in need of a strong leader who will take care of its enemies both external and internal in the only way they respectively understand. Does that leader even exist in Israel anymore, that is the question.

              I wouldn’t have Netanyahu’s job for quids. The fate of Eight million Jewa and Arabs in Israel rests on his decisions made against a background of unprecedented Jew hatred world wide manifestly evident from the UN and European Union down to the PLO and Hamas – both of whom make it plainly clear the the elimination of Israel attempted 66 years ago today still remains their sole and primary goal in 2014.
              Persons with bruised egos and reputations torn to shreds are even more dangerous as the see themselves reduced to laughing stocks whose opinions count for zilch.
              Netanyahu has left Livni and Peres trailing in his wake and has withstood pressures that would have seen weaker men crumble.
              Perhaps it is time for Netanyahu to go on the offensive – to speak the truth, to expose the PLO and Hamas lies and consign Hamas and the PLO to the dustbin of history where they properly belong.
              Netanyahu has the ability and resources to denounce the crude PLO attempts to denigrate and write off the Mandate for Palestine as the inalienable expression of the world conferring legal title on the Jewish people to reconstitute the Jewish National Home in Palestine
              That is a bold vision and it is not going to happen overnight and it will not happen without a lot of pain as the frustrated terrorists within the PLO and Hamas seek to escalate the conflict rather than try to end the 100 year history of violence and armed struggle that has led to so many Arab initiated wars with the deaths of 24000 Jews and the creation of a refugee problem that has ruined millions of Arab lives for generations

              Let those who continue to fawn upon Hamas and the PLO and encourage them to achieve their vile ends live with the consequences of their decisions.

              They have all proved themselves to be absolute and disastrous failures
