In reply to <a href="https://www.jwire.com.au/mahmoud-abbass-desperate-gesture/#comment-187949">Henry Herzog</a>.

Actually the UN did not 'declare Israel' or "create Israel."
In November 1947 the UN merely made a non-binding RECOMMENDATION for a second partition of The Land of Israel, known to many as "Palestine."

The first partition of "Palestine" had been perpetrated by Britain when it gave away to an Arab Emir from the southern Arabian Peninsula [ today, Saudi Arabia] 80% of what Britain itself referred to as "the Jewish National Home." That 80% of 'Palestine'became Jordan.

The UN did, however, admit Israel to membership soon after the Jews of the Yishuv proclaimed their national independence.

The crucial Act of secular international law on the basis of which Israel's legitimacy rests is the 1922 Mandate that was given to Britain for "the reconstitution of the Jewish National Home."
The extent of that Home reached the Jordan River and included the entire city of Jerusalem. In 1948 Jordan captured and occupied illegally the portion of the Home we call Judea and Samaria, but which Jordan named "the West Bank," as well as the old part of Jerusalem.
At the same time Jordan and the local 'Palestinian' Arabs ethnically cleansed all the Jews out of those territories.
At the end of that war, the line of separation between "the West bank" and the rest of Israel became, by mutual agreement, not an international border, but an Armistice Line, which, by mutual agreement, would be negotiated about.
Jordan, however, refused to negotiate and maintained its illegal occupation until the liberation of Judea and Samaria by Israel in 1967.

It needs also to be borne in mind that by virtue of Article 80 of the UN Charter, the validity of that 1922 Act was perpetuated.
Thus the terms "Israeli-occupied 'West Bank", "illegal Jewish settlements"are merely propaganda terminology with no basis in history, law , fact or truth.
Those territories are disputed territories; and the Arab society that refers to itself as "Palestinian" regards all of 'Palestine", including Israel, as "occupied."

The above is only an historical excursus; in actuality, however, the fate of the disputed territory will be determined, by the government and people of Israel.

I always read Ben Cohen's articles with great attention. The contents of his commentaries are well researched and realistic.

Reading the above has given me a rare burst of optimism. With a new and pro-Israel British Prime Minister the laughable attempt by Abbas can only
work against him.

By Abbas wanting to sue England for the Belfour Declaration, he effectively has said that Israel doesn't have a right to exist, and he'll need also to sue the UN for its declaration of Israel.
