An agreement has been reached in the Supreme Court in Sydney allowing to the Yeshiva continued to stay in its Bondi premises for the being moment in spite of an eviction notice been in place since last month.

In a statement issued by the Yeshiva, headed by Rabbi Pinchus Feldman, the organisation makes it clear they want to resolve the dispute between itself and its major benefactor for decades developer Harry Triguboff whose foundation owns the property housing the synagogue.

The statement from the organisation: “The community is aware of the unfortunate current dispute between Yeshiva Synagogue Inc & Sydney Talmudical College Association with Mr Harry Triguboff in relation to the rights of these institutions to continue to operate at the premises situated at 36 and 36a Flood St, Bondi.

On Monday 1 May, an agreement was reached in the Supreme Court of NSW between both parties that until the current tenancy dispute is finalised in court, Yeshiva Synagogue and STCA will allow the renovation works proposed by Meriton on these properties to continue. Meriton is Mr Harry Triguboff’s construction company.

This agreement does not allow for renovation works in the Yeshiva Synagogue Sanctuary and Library but does allow for the relocation of offices in a reasonable way. In turn, Meriton will not press for the immediate termination of the STCA and Yeshiva Synagogue leases prior to the dispute being resolved by the courts.

The dispute encompasses whether the eviction notices issued are valid and also whether Yeshiva Synagogue and STCA have the right to continued occupancy of the premises after the current leases expire in December.

This is a considerable case which will take some time and is scheduled for a preliminary directions hearing in Court on 12 May.

The Boards of Yeshiva Synagogue and STCA are committed to an early and amicable resolution of this matter. Mr Triguboff has been a staunch generous supporter and advocate for the Yeshiva for many years and we are deeply appreciative of his friendship. We are committed to doing all that we can to ensure that this regrettable dispute will not stand in the way of a continuing respectful relationship between our institutions and Mr Harry Triguboff.”

J-Wire has requested a comment from Mr Triguboff.

    I have know both Rabbi Feldman and Mr Triguboff for many decades,in partnership they enabled many thousands of needy Jewish children to receive an education at the Yeshiva.
    Mr Triguboff did something that no one else undertook.
    Harry did not seek the limelight, he excercized extreme generosity undertaking something exceptional.
    I know Rabbi and Mrs Feldman hold Harry in the highest esteem and it goes without saying that they will do everything in their power to reenergize their friendship and community relationship with Mr Triguboff.
    Let all parties be blessed by Almighty G-d to find grace in his counterance.
