Toben granted leave to appeal contempt verdict
Holocaust-denier Dr Fredrick Toben was today granted leave to appeal the verdict of being guilty of contempt of court.In Adelaide’s Federal Court, Justice Anthony Basanko set down August 13 to hear the appeal, forbidding Toben to leave South Australia in the interim other than to visit his lawyer in Melbourne.
Toben had blatantly disregarded court orders barring him from publishing Holocaust denial material on his Adelaide Institute web site.
He had been found guilty on 24 charges of contempt for doing so and is facing three months’ imprisonment for the offences. The case against him had been brought by the the Executive Council of Australian Jewry vice-president, Jeremy Jones.
Justice Basanko gave Toben until June 9 to lodge the appeal against the conviction and the sentence.
