Appearing in Adelaide’s Federal Court yesterday for sentencing submissions, the 65-yr-old publisher of The Adelaide Institute web site told Justice Bruce Lander that he would be upset if his actions offended the court. Toben had been found guilty of 24 counts of contempt of court for refusing to comply with a court order banning him from publishing racist material.

The judge questioned the apology given that Toben had previously withdrawn apologies.

Toben has been jailed in Germany for his Holocaust-denying views.

The judge has adjourned the question of penalty.
