Melbourne lawyer banned from practicising

Melbourne solicitor Alex Lewenberg has been banned from practice for 15 months for rebuking a victim of child sexual abuse who cooperated with police on the basis that “Jewish people should not assist police investigating another Jewish person”.

Lewenberg in 2011 had been acting for now convicted child sex abuser David Cyprys currently serving a five and a half year prison sentence after being found guilty of raping one boy and molesting eight others. Cyprys had been employed at the Melbourne Yeshiva Centre and College.

The judgement delivered by Judge Pamela Jenkins at the Victorian Civil and Administrative Tribunal  contained the contents of a written apology from Lewenberg to the victim known only as AVB. in which Lewenberg wrote: “I apologise to you for what I said and I deeply regret the real hurt and harm those words have caused you.”

In imposing the ban on practice Judge Pamela Jenkins said that it was the fifth time Lewenberg had faced disciplinary action. She also ordered Lewenberg to undertake and complete a course of  legal education in ethics and professional responsibility.

In her judgement, Judge Jenkins said that Lewenberg had spoken to the victim’s foster parent “expressing his disappointment” of the victim’s conduct.

She said that the apology made by Lewenberg “fell short of any expression of genuine remorse.”

Lewenberg was ordered to pay costs to the Legal Services Commissioner who prosecuted the case.

The ban becomes effective on June 1.

    The police are above the law and can commit perjury without penalty .
    The legal system is careful not to step on the toes of such criminals .
    When will the IBAC start doing their job with out fear or favour ?
    As it is you ring to complain and you may be speaking to the person you with to report as I did or the daughter of one of the offenders as I did .
    I was sworn at threatened and taken to court for ringing the IBAC which was said to stalking the criminal .He lost and was named as having acted in a criminal manner .So what is his penalty nothing ?
    Much could be learned from the Jewish people but it would conflict with the “JUSTICE SYSTEM “.
